These Terms and Conditions of Sale (the "TCS") apply, without restriction or reservation, to any purchase of the following services: Sale of private charter flights and other associated travel services, as offered by the Provider to the customer ("The Customer") on the www.flyriviera.com website.
The main characteristics of the Services are presented on the www.flyriviera.com website.
The Customer is required to familiarise himself/herself with them before placing an order. The choice and purchase of a Service is the sole responsibility of the Customer.
These GCS can be accessed at any time on the www.flyriviera.com website and shall prevail over any other document.
The Customer declares that he/she has read these GTS and accepted them by ticking the appropriate box before placing an order online at www.flyriviera.com. In the absence of proof to the contrary, the data recorded in the Service Provider's computer system constitutes proof of all transactions concluded with the Customer.
The Services are provided at the current prices shown on the www.flyriviera.com website when the order is registered by the Service Provider.
Prices are expressed in Euros, excluding VAT and including VAT.
The prices consider any discounts granted by the Service Provider on the www.flyriviera.com website.
These prices are firm and non-revisable during their period of validity, but the Service Provider reserves the right to change prices at any time outside their period of validity.
Prices do not include processing and service charges, which are invoiced in addition, under the conditions indicated on the site and calculated before the order is placed.
The payment requested from the Customer corresponds to the total amount of the purchase, including these charges.
An invoice is drawn up by the Service Provider and given to the Customer when the Services ordered are provided.
Orders are subject to a previously accepted quotation. Quotations drawn up by the Service Provider are valid for 72 hours after they are drawn up.
It is the Customer's responsibility to select the services they wish to order on the www.flyriviera.com website, in accordance with the following procedures:
The Customer validates the quote, the general terms and conditions of sale and the amount of the deposit to be paid for the booking of their trip. Once the information has been validated, the order is considered definitive and will require full payment by the customer in accordance with the terms and conditions.
The sale will not be considered valid until full payment has been received. It is the Customer's responsibility to check the accuracy of the order and to report any errors immediately.
Any order placed on the www.flyriviera.com website constitutes the contract between the Customer and the Service Provider.
The Service Provider reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order.
The Customer may track the progress of his order on the Website.
The due amounts are paid via a secure payment as follows:
The price is payable by the Customer, in full on the day the order is placed, in accordance with the following terms and conditions:
1. To confirm a reservation, a non-refundable deposit will be requested by credit card or bank transfer.
2. Payment of the balance will be requested by the Provider (or other operator/agent) during the booking process. Specific instructions regarding payment method and due date will be provided.
Payment data is exchanged in encrypted mode using the protocol defined by the approved payment service provider involved in banking transactions carried out on the www.flyriviera.com website.
Payments made by the Customer will not be considered final until the Service Provider has received the sums due.
The Service Provider shall not be obliged to provide the Services ordered by the Customer if the Customer does not pay the Service Provider the full price in accordance with the above conditions.
IMPORTANT: To cover unforeseen circumstances, we strongly advise you to take out travel insurance covering all risks. Please contact a travel agency or insurance company for more information.
Failure to arrive at the scheduled check-in time is considered a cancellation with a 100% penalty. The non-refund policy also applies to connecting airline delays, schedule changes and cancellations; problems with immigration and customs controls, family emergencies, medical emergencies, natural disasters, epidemic or pandemic situations, government travel restrictions or bans, acts of terrorism, acts of war or any other reason. Please check your insurance cover with your travel agent or insurance company.
Changes to a confirmed reservation (addition of a passenger, change of schedule, etc.) are subject to availability and approval by the Operations Department. Additional taxes and charges will apply in addition to the handling fee, up to a minimum of 100 euros per change.
The Services ordered by the Customer will be provided as follows:
Reservation service for trips on private aircraft and other associated services.
The said Services will be provided within a period corresponding to the dates of the trip as from the final validation of the Customer's order, under the conditions set out in these GTC at the address indicated by the Customer when placing the order on the www.flyriviera.com website.
The Provider undertakes to use its best endeavours to provide the Services ordered by the Customer, within the framework of an obligation of means and within the time limits specified above.
If the Services ordered have not been provided on the dates of the trip for any reason other than force majeure or the fault of the Customer, the sale of the Services may be cancelled at the written request of the Customer under the conditions set out in Articles L 216-2, L 216-3 and L241-4 of the French Consumer Code. The sums paid by the Customer will then be returned to him at the latest within fourteen days of the date of cancellation of the contract, to the exclusion of any compensation or deduction./p>
In the event of a specific request by the Customer concerning the conditions of supply of the Services, duly accepted in writing by the Service Provider, the costs relating thereto will be the subject of a specific additional invoice at a later date. In the absence of reservations or complaints expressly made by the Customer upon receipt of the Services, the latter will be deemed to comply with the order, in terms of quantity and quality.
The Customer will have a period of 3 weeks from the provision of the Services in which to submit complaints electronically to the Service Provider, together with all the relevant supporting documents.
No complaint will be validly accepted if the Customer fails to comply with these formalities and deadlines.
The Service Provider will rectify as soon as possible and at its own expense the Services whose lack of conformity has been duly proven by the Customer.
Given the nature of the Services provided, orders placed by the Customer do not benefit from the right of withdrawal. The contract is therefore definitively concluded as soon as the Customer places the order in accordance with the terms and conditions specified in these GTCS.
The Service Provider guarantees, in accordance with legal provisions and without additional payment, the Customer against any lack of conformity resulting from a failure to perform the Services ordered under the following terms and conditions: Provisions relating to legal guarantees, Article L217-4 of the French Consumer Code.
The Customer is hereby informed that the collection of his/her personal data is necessary for the sale of the Services and their performance and delivery, entrusted to the Service Provider. This personal data is collected solely for the performance of the service contract.
The personal data collected on the www.flyriviera.com website is as follows
When the Customer orders Services: First name, surname, e-mail address, telephone number.
When paying for the Services offered on the www.flyriviera.com website, the website does not record any financial data relating to the Customer's bank account or credit card.
Personal data is used by the Service Provider and its co-contractors for the performance of the contract and to ensure the efficiency of the service provision, its completion and delivery.
The category of co-contractors is:

The data controller is the Service Provider, within the meaning of the French Data Protection Act and from 25 May 2018 of Regulation 2016/679 on the protection of personal data.
Unless the Customer expressly agrees, their personal data will not be used for advertising or marketing purposes.
The Service Provider will keep the data thus collected for a period of 5 years, covering the period of prescription of the applicable contractual civil liability.
The Service Provider implements organisational, technical, software and physical digital security measures to protect personal data against alteration, destruction and unauthorised access. However, it should be noted that the Internet is not a completely secure environment, and the Service Provider cannot guarantee the security of the transmission or storage of information on the Internet.
Pursuant to the regulations applicable to personal data, Customers and users of the www.flyriviera.com website have the following rights:
These rights, provided that they do not object to the purpose of the processing, may be exercised by sending a request by post or e-mail to the Data Controller whose contact details are given above.
The data controller must respond within a maximum of one month. If the Customer's request is refused, reasons must be given.
The Customer is informed that in the event of refusal, he/she may lodge a complaint with the CNIL (3 place de Fontenoy, 75007 PARIS) or refer the matter to a judicial authority.
The Customer may be asked to tick a box by which they agree to receive informative and advertising emails from the Service Provider. They may withdraw their consent at any time by contacting the Service Provider (contact details above).
The content of the www.flyriviera.com website is the property of the Seller and its partners and is protected by French and international laws relating to intellectual property.
Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.
These GCS and the transactions arising from them are governed by and subject to French law.
These GCS are written in French and translated into English. In the event of a dispute, only the French text shall be deemed authentic.
For any complaint, please contact the customer service department at the postal address or email address of the Service Provider indicated in ARTICLE 1 of these GTC.
The Customer is hereby informed that, in the event of a dispute, he/she may have recourse to conventional mediation, to existing sector mediation bodies or to any alternative dispute resolution method.

All disputes arising from the purchase and sale transactions concluded pursuant to these GTCS and which have not been settled amicably between the seller or by mediation, will be submitted to the competent courts under the conditions of common law.
Fly Riviera (or its agents) reserves the right to substitute an aircraft offering similar value and transport characteristics without prior notice or financial compensation. In certain weather, regulatory and/or safety circumstances, the aircraft will not be able to take off and the journey will be cancelled. Fly Riviera (or its agents) in collaboration with the operator will examine these problems affecting your journey and offer the best alternative solution to minimise disruption to the journey. Some airports are subject to landing restrictions at sunrise and sunset. No take-offs or landings are permitted outside daylight hours. Fly Riviera (or its agents) will not be responsible for any delay and/or cancellation of the charter booking due to delay of connecting flight, air traffic congestion, or other, which may occur at the transit airport.
All passengers (including children and infants) must be in possession of valid travel documents prior to travel. This may include a valid passport, identity card and, in some cases, a visa. It is the passenger's responsibility to check the validity of the documents (including expiry dates) and any visa requirements for the country visited. Copies of these documents will be requested by Fly Riviera during the booking process to comply with government agencies.
Failure to provide valid travel documents within the specified time will result in cancellation of the booking and loss of any monies paid by the Customer.
All passenger travel documents must be uploaded during the booking process, in accordance with the instructions provided by the Provider.
Except for last-minute bookings, travel documents received at short notice prior to charter departure will be subject to a late processing fee of 100 euros per document.
To speed up the processing of the booking and to avoid any additional charges, it is recommended to provide the required documents at the time of booking, using the travel documents upload link (as per the instructions provided to the Customer by the Provider).
Each passenger is entitled to one item of checked baggage + one personal item (i.e. a cabin bag that must be placed under the seat). The dimensions and weight of checked baggage must not exceed 63 cm x 46 cm x 30 cm and 23 kg. The dimensions and weight of personal items must not exceed 40 cm x 30 cm x 20 cm and 5 kg. Oversized baggage is not permitted. Special baggage items (e.g. children's pushchairs, sports equipment, animal cages, etc.) must be approved in advance by the Operations Department. If baggage does not comply with the above restrictions, the captain or ground operations staff may decide to unload it before departure, without financial compensation.
Most charter aircraft are small and limited in size. For reasons of comfort and safety, the following restrictions apply to all passengers: maximum weight 100 kg; maximum height 1.90 m. Passengers exceeding these limits must be approved in advance by the Operations Department. Passengers requiring a wheelchair (or other medical assistance) must contact the reservations department to confirm availability prior to booking.
Fly Riviera refers to SKY SEA COMPANY SAS, a French corporation and other parties responsible for providing air charter services.
All network partners are certified air taxi operators required to adhere to safety requirements set forth by Civil Aviation Authorities.
